Statement of Credit Terms and Disclosure of Finance Charges
The purpose of this Statement of Credit Terms and Disclosure of Finance Charges is to provide for the extension of convenient credit to customers with approved credit privileges. Customers are urged to make necessary long-term financing arrangements with their bank or other sources or ask us for further assistance.
All purchases made on credit during the month are due and payable upon receipt of the monthly statement. All purchases are due thirty days after the invoice date (herein after referred to as “Due Date”). A discount may be available on products purchased if paid within 14 days of receipt of invoice statement (herein after referred to as “Discount Due Date”) and the entire balance of the account is current and paid in full.
Mettler Fertilizer, Inc. may, at any time, revoke and/or suspend the customer’s privilege of purchasing on credit with respect to future purchases of products or services.
In the event a customer’s account had previous credit privileges but the credit privileges were suspended, for any reason, the credit privileges may be re-granted to the customer after the customer has re-earned the credit privilege.
In the event the customer would like to prepay for product, the customer’s account must be current.
Customer agrees that all products and services are purchased for customer’s own use. To the extent, if any, customer’s use of such products and services is for or involves others, customer agrees that Mettler Fertilizer, Inc.’s Conditions of Sale – Limited Warranty and Limitation of Liability and Remedies shall also apply to such third parties, and customer will hold harmless and indemnify Mettler for any loss in excess thereof.
All monthly account balances must be paid in full when the customer’s credit limit is reached or by the Due Date, whichever occurs first.
Mettler Fertilizer, Inc. claims no liability unless any loss, damage, injury or other claim is reported to Mettler Fertilizer, Inc. in writing within thirty (30) days after discovery, and the failure to give notice to Mettler Fertilizer, Inc. of any claim within such period shall constitute an absolute unconditional waiver of such claim.
Mettler Fertilizer, Inc, may, at any time, amend the provisions of this Statement of Credit Terms and Disclosure of Finance Charges upon notice mailed to the customer at his last known address, and the purchase of product or service subsequent to the effective date of such amendment shall constitute an acknowledgement and acceptance by the customer of such amendment.
By using a Mettler Fertilizer, Inc. credit account, the customer grants Mettler Fertilizer, Inc. a purchase money security interest in all products purchased through the customer’s account, in addition to any proceeds from using these products. The purchase money security interest continues until the products are paid in full.
A periodic rate of 1.5% per month, which is an ANNUAL PERCENTAGE RATE equal to 18%, or the maximum rate allowed by law, whichever is less, will be applied to accounts as noted below.
In the event the purchase price of each product item is not paid in full within thirty (30) days from the Due Date, a Finance Charge will be assessed and due on the unpaid balance from the date of the first monthly statement reflecting such purchase until payment is received in full by Mettler Fertilizer Inc. and credited to customer’s account.
In the event the purchase price of each product item is not paid in full within sixty (60) days from the Due Date, the customer will no longer have credit privileges with Mettler Fertilizer, Inc. and the customer will be allowed to make purchases on a cash only basis.
In the event the purchase price of each product item is not paid in full within one hundred eighty (180) days from the Due Date, the account will be classified as delinquent.
When an account is classified as delinquent, the customer shall be liable for the payment of all our collection costs, court costs, and reasonable attorney’s fees to pursue payment of the customer’s debt.
